Alternative for Germany: Bundestag rejectsStephan Brandner's appeal

Federal Constitutional Court backs Bundestag's decision

Bundestag’s decision justified

The Federal Constitutional Court has rejected an appeal by Stephan Brandner, a member of the Alternative for Germany (AfD) party, against his expulsion from the Bundestag.

Brandner was expelled from the Bundestag in 2020 after he was convicted of incitement to hatred by a regional court. The Bundestag's decision was based on Article 46 of the German Basic Law, which states that members of the Bundestag can be expelled if they are found to have engaged in conduct that is "incompatible with the dignity of the Bundestag".

Brandner's appeal was based on the argument that the Bundestag's decision was politically motivated and that he had not been given a fair hearing. However, the Federal Constitutional Court rejected these arguments, ruling that the Bundestag's decision was justified and that Brandner had been given a fair hearing.

Brandner's expulsion sends a strong message

Brandner's expulsion from the Bundestag is a significant event, as it sends a strong message that hate speech will not be tolerated in German politics.

The AfD has been criticized for its anti-immigrant and anti-Muslim rhetoric, and Brandner's expulsion is likely to further isolate the party from the mainstream of German politics.

The Federal Constitutional Court's decision is a welcome development, as it shows that the German judiciary is committed to upholding the principles of democracy and human rights.
